1. General Terms and Acceptance

1.1 Agreement: These Terms and Conditions (“Terms”) govern the sale of video games, gift cards, in-game currencies, software, game consoles, accessories, and related products (“Products”) by OGSBD (“We,” “Us,” “Our”) to the customer (“You,” “Your”).

1.2 Governing Law: These Terms are governed by and construed in accordance with the laws of the People’s Republic of Bangladesh. Any disputes will be subject to the exclusive jurisdiction of the courts of Bangladesh.

1.3 Acceptance & Legal Capacity: By placing an order, you agree to be bound by these Terms and confirm you are legally competent to enter into a contract under the Contract Act, 1872 (sound mind and 18+ in Bangladesh).

2. Products, Pricing, and Orders

2.1 Product Information: We strive to keep product descriptions, images, and prices accurate. If errors occur, we may correct them and update information without prior notice.

2.2 Pricing: All prices are stated in Bangladeshi Taka (BDT) and are inclusive of VAT/taxes as required by Bangladeshi law, unless stated otherwise.

2.3 Order Confirmation: An order confirmation means we received your request, but it does not confirm acceptance. We may accept or decline any order due to availability, price/description error, or suspected fraud.

2.4 Stock Availability: Orders are subject to stock availability. If an item is unavailable, we will inform you and offer an alternative or a full refund.

3. Payment

3.1 Payment Methods: We accept payment methods shown on our website or at checkout, including Cash on Delivery (COD), mobile financial services (e.g., bKash, Nagad), and bank payments.

3.2 Payment Failure: Your order will be processed only after successful payment. If a payment is unsuccessful, we will notify you and your order may be cancelled.

4. Shipping and Delivery

4.1 Delivery Area: We deliver within Bangladesh only.

4.2 Delivery Times: Estimated delivery times are for reference and not guaranteed. We are not liable for reasonable or unavoidable delays.

4.3 Risk of Loss: The risk of loss or damage to Products passes to you upon delivery. If a package appears damaged or tampered with, refuse delivery and notify us immediately.

4.4 Delivery Address: You must provide a complete and accurate delivery address. We are not liable for non-delivery or misdelivery caused by incorrect address details.

5. Return, Refund, and Warranty Policy

5.1 Consumer Rights: Your rights under the Consumer Rights Protection Act, 2009 remain protected and unaffected by these Terms.

5.2 Physical Consoles/Games/Disks/Accessories:

• Dead on Arrival (DOA): If a new, sealed physical product is non-functional upon receipt, notify us within 24 hours. We will arrange replacement or refund after inspection.
• Used/Pre-Owned Goods: Sold “as is.” Any limited warranty (if offered) will be stated on the product page.

5.3 Digital Codes/Licenses (Non-Refundable):

• Sale Final: Digital codes, gift cards, pre-orders that include an immediate digital code, and digital licenses are final and non-refundable.
• Non-Functioning Codes: If a code is genuinely invalid, notify us within 24 hours. We will verify and then issue a replacement or refund if confirmed invalid.
• User Error: We are not responsible for purchases made for the wrong region, platform, or due to other user mistakes.

5.4 Warranty for Consoles/Hardware: Any manufacturer’s warranty offered is handled by the manufacturer. We may assist you in coordinating warranty claims where reasonably possible.

6. Limitation of Liability

6.1 Maximum Liability: To the maximum extent permitted by Bangladeshi law, our total liability is limited to the total amount you paid for the specific Product.

6.2 Indirect Loss: We are not liable for indirect, incidental, punitive, or consequential losses, including loss of profit, revenue, or data.

7. Intellectual Property

7.1 Ownership: All copyrights and trademarks in Products belong to their respective licensors/developers. Your purchase grants a limited license to use the Product under the licensor’s terms and does not transfer ownership of intellectual property.

8. Amendments to Terms

8.1 Updates: We reserve the right to amend these Terms at any time. The most current version will be posted on our website. Continued use of our service after changes means you accept the updated Terms.
